Asian Arbitration Conference 2004

A leading Asian Arbitration Conference will be hosted by the Australian Centre for International Commercial Arbitration ("ACICA") in Sydney this year. This Conference brings together the heads of various major arbitration centres and other experienced practitioners from throughout Asia to discuss issues in international commercial arbitration facing the Asia-Pacific region.

SIAC will participate in panel discussions during this Conference.

Chairman of SIAC Board

Mr Goh Joon Seng is appointed as Director and Chairman of SIAC's Board of Directors. He will chair the Board, which oversees the strategic directions of SIAC, enabling it to undertake an enhanced role in the development of international arbitration in Singapore.

India Construction Industry Chooses SIAC to Set Up Dispute Resolution Centre

SIAC and the Construction Industry Development Council in India (CIDC) signed a Memorandum of Understanding to set up a joint dispute resolution centre in New Delhi. The Centre will facilitate the resolution of construction-related disputes arising in India, estimated at close to US$12b.

Working with CIDC, SIAC will lend its experience to institute a system of case administration as well as expertise in developing a set of rules specific for the construction industry in India; developing a training and accreditation programme for the appointment of arbitrators to the panel in the Centre; and developing a training programme for mediation.

SIAC’s New Appointing Process

To uphold the tradition of transparency, integrity and efficiency in the work that we do, SIAC is pleased to publish a new appointing process. This will be followed when a request for appointment is filed at the Centre with effect from 20 July 2004. There are 3 steps in the new appointing process: an initial selection and ranking of candidates will be made by the Nomination Committee; this will be followed by a confirmation, re-ranking or rejection by the Confirmation Council; and based on the outcome of the preceding steps, the final appointment will then be made by the Deputy Chairman of SIAC.

Chief Justice Appoints Assoc Prof Lawrence Boo to Act as Appointing Authority

The Chief Justice has appointed Assoc Prof Lawrence Boo to act as the default appointing authority for arbitrators under the International Arbitration Act Cap 143A (2002 Ed) and the Arbitration Act Cap 10 (2002 Ed). The appointment takes effect from 1 June 2004. The appointment was made on 23 June 2004 and published in the Government Gazette on 2 July 2004.

Open Door for Foreign Representation in Singapore Arbitration

Section 35 of the Legal Profession Act is amended to remove all restrictions on foreign lawyers representing parties in arbitration in Singapore. The repealed provision formerly limited participation of foreign lawyers in arbitration proceedings in Singapore only where the applicable law of the contract was not the law of Singapore; and where Singapore law was the applicable law, they had to do so jointly with a Singapore lawyer.

With this new provision, foreign lawyers have unfettered representation in arbitration proceedings in Singapore, whether domestic or international. In addition, foreign lawyers may give advice, prepare documents and provide assistance in relation to, or arising out of arbitration proceedings - with the only exception being appearance in local court proceedings.

17th ICCA Conference

Another significant world arbitration event, the 17th Conference of the International Council for Commercial Arbitration ("ICCA") is being staged in Beijing in May. The conference draws together commercial arbitration experts from all corners of the world to discuss an interesting line-up of topics, including the role of arbitrators as settlement facilitators, the enforceability of awards and the current UNCITRAL work on interim measures of protection.

SIAC's Chairman, Mr Warren Khoo, will speak at the roundtable discussion on Arbitration and Conciliation Concerning China. A former judge of the Supreme Court of Singapore, Mr Khoo will also take part at a Judges' Meeting on the enforcement of arbitral awards.

Associate Professor Lawrence Boo returns to SIAC

Founding CEO and Registrar of SIAC, Associate Professor Lawrence Boo has been appointed as a new Director on the Board of the Singapore International Arbitration Centre. He joins SIAC as Deputy Chairman with effect from 3 May 2004.

International Congress of Maritime Arbitrators XV

An important event in every maritime and commercial arbitrator's diary, the XVth International Congress of Maritime Arbitrators takes place in London this year. The Rt Hon Lord Bingham of Cornhill, Senior Law Lord will give the Keynote Address and The Rt Hon Lord Mayor of London, Alderman Robert Finch will give the Cedric Barclay Memorial Lecture.

Singapore Wins Bid to Host International Congress of Maritime Arbitrators XVI

The Singapore International Arbitration Centre is pleased to announce the success of its joint bid with the Maritime Law Association of Singapore and the Singapore Institute of Arbitrators to host the XVI International Congress of Maritime Arbitrators. We look forward to welcoming delegates to this prestigious conference, to be held in Singapore in 2006/2007.

SIAC Rules Take Centre Stage at International Moot Competition

Over 130 universities from more than 40 countries from all the continents of the world, including some of the most prestigious law school, are sending their brightest and most articulate law students to Vienna to take part in this year's Willem C Vis International Commercial Arbitration Moot competition. Named after a former head of the United Nations Commission on International Trade Law (UNCITRAL), this annual event also attracts hundreds of the world's prominent arbitrators, some of whom preside over the moot sessions.

This year's moot problem features the SIAC Rules as the institutional rules governing the arbitration. Mr C R Rajah SC, an arbitrator on SIAC's panel, also sits as Chairman of the Tribunal during the final round of the competition.

Mock Arbitration Debuts at Maritime Show

SIAC, in conjunction with Reed Exhibitions, is pleased to present mock arbitration sessions at Asia's premier maritime event - Asia Pacific Maritime 2004. Delegates will see how common disputes such as claims for cargo damage and advance freight are resolved by arbitration under SIAC Rules.

The sessions will take place on 24 March and 25 March at the following times: 1 - 2 pm and 3 - 4 pm. SIAC's booth will be located at 3G02A2 in Hall 3, Singapore Expo.

SIAC Users Enjoy More Savings

SIAC celebrates the new year with another move towards quality arbitration at a sensible cost. Doing its part to keep the cost of arbitration in Singapore down, SIAC completes its review and rationalization of all its fees and charges, an exercise that began in September 2002. Users now pay new, lower rates for the use of facilities and services and new, lower fees for taxation of party and party costs. New preferential rates also apply to frequent users of SIAC's appointment and case management services.
