A new appointing process takes effect on 20 July 2004. There are 3 steps in this process:

1. Nomination Committee
   
  The Nomination Committee, comprising at least 2 legal officers of the SIAC, will shortlist possible candidates for appointment. The nominations will be based on the matching of expertise / experience and nature of disputes; time availability of candidate; number of arbitration appointments made (to ensure fair distribution of cases); historical performance of cases handled and so on. The Nomination Committee shall submit a 'ranked' list of 3-4 candidates to the Confirmation Council for a sole arbitrator and 7-8 candidates for a 3-member tribunal within 3 days of the request.
   
2. Confirmation Council
   
 

The Confirmation Council comprises 4 members of which at least 2 members are from the SIAC Board of Directors. Any 2 or more members of the Confirmation Council will then

(i) confirm or otherwise reject the list; or
(ii) re-order the ranking.

   
  If at least 2 members of the Confirmation Council respond within 3 days of the submission, the list shall be submitted to the Deputy Chairman of SIAC.
   
3. Appointment by Deputy Chairman
   
 

The Deputy Chairman of SIAC will make the appointment of the candidate who ranks first on the list received from the Confirmation Council unless there are circumstances within his knowledge to warrant a departure.

If there is no response from at least 2 members of the Confirmation Council within 3 days of submission to them, the Deputy Chairman will make the appointment from the list submitted by the Nomination Committee.

If the Confirmation Council rejects the list, the Deputy Chairman will make a fresh appointment of a candidate not on that list.
